Terms and Conditions
1) Definitions
1.1 ‘Buyer’ means the person who buys the goods from the seller.
1.2 ‘Conditions’ means the terms and conditions of sale as set out below. These terms and conditions apply exclusively to any contract between the buyer and the seller.
1.3 ‘Delivery date’ means the date specified by the seller when the goods are to be delivered.
1.4 ‘Goods’ means the articles when the buyer agrees to buy from the seller.
1.5 ‘Seller’ means TS Granite Ltd, Unit 6 Bendall Head Farm, Cannock Road, ST17 0SG.
2) Conditions
2.1 These conditions shall apply to all contracts for the sale of the goods by the seller to the buyer to the exclusion of all other terms and conditions including any terms and conditions which the buyer may purport to apply under any purchase order confirmation of order or similar document.
2.2 All orders for goods shall be deemed to be an offer by the buyer to purchase goods pursuant to these conditions.
2.3 Acceptance of delivery of these goods shall be deemed conclusive evidence of the buyer’s acceptance of these conditions.
2.4 Any variation to these conditions (including any special terms and conditions agreed between the parties shall be in applicable unless agreed in writing by the seller).
3) The price and payment
3.1 The price shall be the seller’s Invoiced price. The price is exclusive of VAT which shall be due at the rate of ruling on the date of the seller’s invoice.
3.2 Payment of the price and VAT shall be due within 7 days of the invoice.
3.3 Interest of overdue invoices shall accrue from the date when payment becomes due from day to day until the date of payment at a rate of 8% per anum above Lloyd’s Bank’s base rate from time to time in force and shall accrue at such a rate after as well as before the judgement.
3.4 All goods remain the property of the seller until payment is made. The seller reserves the right to remove any product from the buyer’s premises for any non-payment and store it in our yard for a period of no more than 3 months and if no payment is received it shall be disposed of. The purchaser will be liable for storage costs whilst the goods are stored at TS Granite ltd. The purchaser will be liable for a delivery and installation charge before the product is returned to site if payment is subsequently made and accepted.
3.5 The buyer will be liable for any legal expenses accrued during legal action taken in the instances of non-payment of goods.
4) Goods
4.1 The quantity and description of the goods shall be set out in the seller’s quotation.
4.2 No representations, warranties or conditions are given to the quality of the goods supplied as to their fairness for any purpose of job or use which the buyer intends for the goods to be supplied. The buyer should inspect the goods himself and satisfy himself thereby that they are of quality and suitability for the purposes for which he intends to use them.
4.3 All natural materials supplied are subject to natural markings, veining’s, variations in colour, cracks, and vent. These are supplied, cramped, stopped or reinforced where necessary and no claim on this account can be made.
4.4 All thicknesses quoted are nominal and no liability is accepted for reasonable variations of whatever nature.
5) Delivery of Goods.
5.1 Delivery of the goods shall be made to the buyers address on the delivery date. The buyer shall make all arrangements necessary to take delivery of the goods whenever tendered for delivery
6) Acceptance of Goods
6.1 The buyer shall be deemed to have accepted goods 24 hours after delivery to the buyer.
7) Title and Risk
7.1 The goods shall be at the buyer’s risk as from delivery.
7.2 Title to the goods shall only pass to the buyer on payment in full of the invoice price for such goods.
8) VAT
8.1 This confirmation is based upon the current rates of value added tax. In the event of any changes in this rate, the new rates shall be changed on the final invoice.
9) Samples
9.1 Samples of materials for which the company has quoted would fairly represent the class of material which would be supplied but due to the material being subject to natural markings, veining’s and variations in colour.
9.2 Any descriptions of the material offered are for guidance only and do not imply suitability for any purpose.
10) Delivery
10.1 Delivery dates are approximate, if the company is prevented from or delayed in delivery owing to bad weather, breakdown of plant machinery used in production or delayed shipment of material from wholesalers of from any cause over which we have no control, the company shall not be liable to the purchaser due to the failure or delay by the company in delivering goods.
11) Proper law of contract
11.1 This contract is subject to the law of England and wales.
11) Guarantee
12.1 The material and the workmanship is guaranteed for one year after the delivery date subject to and upon the terms and conditions set out above.
Plus, the Following:
· All prices are valid for 30 days from the quotation date
· All prices are quoted based on works being carried out during normal working hours, having clear working areas with no interference from other traders.
· Retail payments: 30% deposit on order, a further 60% is taken on template with the remaining 10% due upon completion.
· All deposits are non-refundable.
PLEASE NOTE THE FOLLOWING:
Natural Stone: It should be understood that stone is natural and, as such, is subject to variation in colour, shading, veining and mineral composition. Samples are provided purely as a guide to the material(s)selected and cannot be relied on to match exactly the material(s) supplied.
Whilst we endeavour to avoid any natural imperfection during the manufacturing process, we cannot be held responsible for any fault lines. Veins, fissures, pit marks or cracks that may appear during fabrication. Similarly, we cannot be held responsible for any corrosion, staining, scratching, or marking that may occur during normal use of the finished product.
Site Survey Conditions:
All kitchen furniture should be installed and in its final position including base and wall units prior to installation. All base units should be properly secured, level and Plumb. Working areas should be accessible and surfaces cleared. Any temporary work surfaces and fitted sinks should be removed.
Additional charges will apply if these conditions are not met when our surveyors/fitters attend site.
Worktop Supports: All base units should be fitted with adequate worktop supports, particularly corner voids, appliance spaces and where base units or end panels are not fitted along rear walls or at the ends of runs. Calculations for supports or fixings should be based on a worktop weight of 90kg/m2.
TS Granite does not make final connections to water, electrical and gas services,
These must be undertaken by suitable qualified tradesmen
Conditions of sale are available upon request. No work shall be under taken without acceptance of terms and conditions.
